In the mountains of Eastern Kentucky, a two-lane road along a creek may be the only way in or out of a hollow, and it’s often shared with loaded coal trucks, log trucks and school buses. Mountain counties get no special exemption from Kentucky’s no-fault rules. Whoever is hurt typically turns to PIP first. A negligence suit against whoever caused the wreck generally must be on file within two years, measured from the date of injury or the last PIP benefit paid (KRS 304.39-230). Partial fault reduces recovery under comparative fault.
