Car Accident While Pregnant in Kentucky: Medical Steps and Your Rights

Being in a car accident while pregnant is frightening, even when you feel fine. A seat belt, an airbag or a sudden stop can affect a pregnancy in ways that aren't obvious at the scene. The first priority is getting you and your baby checked. After that, it helps to know how Kentucky handles medical bills, what you can recover, and what the law says if the pregnancy is harmed.

Why you should get checked even after a minor crash

Doctors often recommend an evaluation after any crash during pregnancy, even a low-speed one. Some complications, such as the placenta pulling away from the wall of the uterus (placental abruption), may not cause symptoms right away. Hospitals commonly monitor the baby for a period after trauma.

Get care right away if you notice:

  • Vaginal bleeding or leaking fluid
  • Cramping, contractions or abdominal pain
  • Less movement from the baby
  • Dizziness, fainting or a severe headache
  • Pain where the seat belt crossed your body

Tell every provider you're pregnant and that you were in a crash. Those records matter for your health and for any claim later.

What to do after a car accident while pregnant

  1. Call 911 and say you're pregnant. Let paramedics check you.
  2. Go to the hospital or call your OB the same day, even if you feel okay.
  3. Follow up on every appointment, including extra monitoring or ultrasounds.
  4. Photograph the cars, the scene and any bruising from the seat belt.
  5. Don't post about the crash or your pregnancy online. See social media after an accident.
  6. Report the crash to your insurer and ask about PIP.

Going forward, doctors generally recommend wearing the lap belt low across your hips, below your belly, with the shoulder belt between your breasts.

Who pays your medical bills?

If a crash causes injuries that affect your baby, a claim can include the child's own medical care and long-term needs. These cases depend heavily on medical evidence linking the crash to the harm, so detailed records from the day of the crash forward are important.

What Kentucky law says if a pregnancy is lost

Kentucky's highest court held decades ago that a viable unborn child is a "person" under Kentucky's wrongful death statute. "When a pregnant woman is injured through negligence and the child, if it be a viable infant … suffers death as a consequence, a right of recovery exists," as long as the negligence is proven to have caused the death (Mitchell v.
