Make sure you’re asking the right agency

LMPD covers most of Louisville Metro, but not every crash in Jefferson County. Some small cities have their own police departments (for example, Shively, St. Matthews and Jeffersontown), and some crashes are worked by Kentucky State Police or another agency. Request the report from whichever agency’s officer came to the scene. The officer’s card or the paperwork you were given should name the agency.

LMPD also notes that if you filed your report through the Kentucky State Police website, you need to get it from KSP, not LMPD.

No officer came? If no police officer investigated and the crash caused more than $500 in property damage, Kentucky law requires the drivers to file a written report with Kentucky State Police within 10 days (KRS 189.635(5)). KSP takes these civilian reports through its online Civilian Collision Reporting portal. The system gives you a report number and the option to download your report, so save a copy right away. See our Kentucky State Police accident report guide for details.

Who can get a copy of a Kentucky crash report

Kentucky crash reports are not open to the public. Under KRS 189.635(6), police may release a report only to:

  • the people involved in the crash
  • parents or guardians of a minor involved in the crash
  • the insurers of anyone named in the report (or their written designee)
  • the attorneys for people involved in the crash
  • a party to a lawsuit who sends a copy of the first page of the clerk-stamped complaint naming all parties
  • certain government agencies and news organizations, as the statute allows

Bring a photo ID if you go in person. If a lawyer is helping you, the lawyer can request the report for you.

Check the report for errors

When you get your report, check names, insurance information, vehicle details, the location, the diagram and the officer’s narrative. Mistakes happen, and an error about who was where can cause trouble with an insurance claim. Ask the agency that wrote the report how to request a correction or add a supplemental statement, and do it early. Our general guide to Kentucky accident reports explains how corrections work.

The report is important evidence, but it isn’t the final word on fault. Officers usually arrive after the crash and may not talk to every witness. Insurance adjusters and courts look at all the evidence, including photos, video, witness statements and vehicle damage.

Why your crash report matters

Your insurer and the other driver’s insurer will usually ask for the report number early. Kentucky’s no-fault (PIP) coverage pays medical bills and lost wages regardless of fault, but you still need the report to show what happened if you make an injury claim against the at-fault driver. Learn how Kentucky PIP works.

If you were hurt, talk with a lawyer before you give a recorded statement to the other driver’s insurer. Our Louisville personal injury lawyer page explains how we help, and our car accident lawyer page covers crash claims in detail.
