How Northern Kentucky differs from the rest of the state

Three things shape injury cases here. First, Ohio is minutes away, so the other driver often carries an Ohio policy and the adjuster may argue Ohio rules. Second, the region is a freight hub. I-71 and I-75 merge through Kenton County, I-275 loops the metro area, and the Cincinnati/Northern Kentucky International Airport in Boone County moves large volumes of air cargo. That puts tractor-trailers and delivery vans on every major road. Third, Kentucky’s border with Ohio follows the river’s northern shore (the low-water mark as it stood in 1792), so a crash on a bridge span may well be in Kentucky, even when both drivers live in Ohio.

Each county runs its own Circuit Court. Boone County cases go to the Boone County Justice Center, 6025 Rogers Lane, Burlington. Kenton County cases go to the Kenton County Justice Center, 230 Madison Ave., Covington (Kenton County court listing). Campbell County cases go to the Campbell County Courthouse, 330 York St., Newport. Where you file usually depends on where the crash happened or where the defendant lives, and that choice affects which jury pool hears your case.

Freight, airport and warehouse traffic

Distribution centers line the interstates in Boone and Kenton Counties, and the airport’s cargo operations run around the clock. Once it stops paying, a two-year window to file against the negligent motorist generally keeps running from that last check or from the injury date, whichever comes later (KRS 304.39-230). Kentucky’s pure comparative fault rule is friendlier to the injured than Ohio’s more-than-half bar.

Do I need a Cincinnati lawyer if the other driver is from Ohio?

Not for a crash that happened in Kentucky. That case is usually filed in Kentucky, and Kentucky law generally applies.

Which Northern Kentucky court will hear my case?

Usually the Circuit Court of the county where the crash happened: Boone in Burlington, Kenton in Covington or Campbell in Newport.

Can a federal court get involved?
