The Highlands is one of Louisville’s busiest neighborhoods for people on foot, with restaurants, shops and bars lining Bardstown Road and Baxter Avenue and Cherokee Park just to the east. If you need a Louisville Highlands personal injury lawyer, Forman & Associates Accident Injury Lawyers is about three miles away. Our office at 1139 S. 4th St. is roughly a 10-minute drive, so we can meet you at home, at the hospital or at our office the same day you call.

The Highlands has narrow streets, on-street parking on both sides, and crowds on the sidewalks day and night. People cross mid-block, drivers circle looking for parking, and cyclists and scooter riders squeeze between moving traffic and parked cars. That leads to crashes you don’t see as often elsewhere: pedestrians hit near restaurants, cyclists hit by an opening car door, and low-speed collisions with surprisingly serious injuries. In and around Cherokee Park, runners, walkers and cyclists share winding park roads with drivers using them as a shortcut.
Highlands injury lawsuits are filed in Jefferson Circuit Court at the Jefferson County Judicial Center, 700 W. Jefferson St. downtown, a short drive from both the neighborhood and our office.
Kentucky law requires drivers passing a bicycle or electric scooter in a single lane to leave at least three feet when there’s room (KRS 189.340). Drivers and passengers also have to check before opening a door into traffic. When they don’t, a rider can be thrown into the street. If you were walking, biking or riding a scooter, PIP may still cover your medical bills, through your own auto policy, a household policy or the car involved. If a bar served someone who was visibly intoxicated, Kentucky’s dram shop law may allow a limited claim. See our bicycle and pedestrian collision, e-scooter crash and dram shop pages.
On Bardstown Road, PIP often covers pedestrians and riders as well as drivers. A claim against the careless motorist generally must be filed within two years from injury or PIP’s last payment (KRS 304.39-230). Comparative fault only reduces recovery.
You can phone a Louisville Highlands personal injury lawyer without getting anything together first. If you can, keep the LMPD report number, photos of the street, the parked car or the crosswalk, and the names of businesses nearby. Many of them have cameras. Don’t repair a damaged bike or scooter, and keep a cracked helmet.
Many Highlands homes and storefronts are more than a century old. Brick and concrete sidewalks heave over tree roots, steps lack handrails and lighting can be poor on side streets. A fall on a broken sidewalk, a rental property’s porch or a restaurant’s stairs can cause serious injuries, and who is responsible depends on who owns or controls the spot. Claims involving city property may require special notice. Take photos of the exact defect, with something in the frame to show its size, and keep your shoes. See our slip and fall and premises liability pages.
Often the person who opened the door, though every case depends on the facts. That person’s auto policy may cover the claim.
PIP may cover your medical bills in many cases. The driver’s liability coverage may cover the rest.
