If a private driver caused your Frankfort crash, it’s an ordinary Kentucky injury claim. If a state employee driving for work or a state agency caused it, the claim generally goes to the Kentucky Board of Claims instead of a regular court, and different rules apply. Contractors working for the state, such as road crews, can often still be sued in Circuit Court. Figuring out who was actually responsible is the first step. Franklin Circuit Court also hears many cases involving state government, so its judges handle these issues often.
Franklin Circuit and District Courts sit in the Franklin County Courthouse, 222 St. Clair St., Frankfort, KY 40601. The courthouse reopened on September 2, 2025, after flood repairs (Kentucky Court of Justice announcement).

Under KRS 49.040, the Board of Claims has exclusive jurisdiction over negligence claims against the Commonwealth and its agencies. A single award can’t exceed $250,000, and the total for multiple claimants from one negligent act is $400,000. Under KRS 49.120, claims generally must be filed within one year of when the claim accrued. That is far shorter than the two years many car crash victims expect, so don’t wait.
If a private driver caused your crash, PIP pays first (how PIP works), and the deadline is generally two years from the injury or the last PIP payment (KRS 304.39-230). If a state vehicle was involved, plan on the Board of Claims’ one-year deadline. Our car crash lawyer page has more.
