Social Security Disability After a Serious Injury

If a serious injury keeps you from working for a year or more, Social Security Disability may help. Here’s how it relates to an injury claim.

Reviewed by Larry Forman, Attorney.

A serious injury can keep you out of work for months or longer. Social Security Disability programs are separate from an injury claim, but the two can affect each other. This page is general information to help you understand the basics.

SSDI and SSI

Social Security generally considers you disabled only if you can’t do substantial work and your condition is expected to last at least a year or result in death. See ssa.gov/disability.

How an injury settlement can affect benefits

An injury settlement usually doesn’t reduce SSDI, but it can affect SSI and Medicaid eligibility. Medicare may need to be repaid for injury-related care. Planning the settlement matters. See medical liens.

Where to start

  1. Apply with Social Security online, by phone or at a local office.
  2. Keep copies of all medical records.
  3. Tell your injury lawyer if you apply for or receive benefits.
