What are aggravating circumstances?

Aggravating circumstances result in a higher mandatory minimum jail sentence. If you are charged with a DUI with an aggravator, contesting the DUI becomes more complicated and you may not even be eligible for Diversion as a result even if it is your first offense.

  1. Driving more than 30 mph over speed limit
  2. Going the wrong way on a limited access highway
  3. Causing an accident that results in death or serious physical injury
  4. Having an alcohol level of .15 or more within 2 hours after operating
  5. Refusing to submit to blood, breath, or urine testing
  6. Transporting passengers under 12 years of age
